LEVEL IA EXEMPTION UPDATE

Due to changes made to the Code of Federal Regulations (CFR), grandfathering of technician certifications will no longer be allowed.

The Federal Highway Administration (FHWA) has recently conducted a Materials Quality Assurance Stewardship Review of the Texas Department of Transportation (TxDOT), The objective of this stewardship review was to review TxDOT’s materials Quality Assurance Program (OAP) practices and procedures, and to ascertain the status of TxDOT’s implementation of Code of Federal Regulations CFR 637 Subpart B – Quality Assurance Procedures for Construction. The Level 1A-E technician certification was defined as one area of improvement, specifically based on the utilization of the current grandfathering (Level 1A-E) status.

Based on this stewardship review and the following published information from NS 23 CFR, Part 637B, “The following are not appropriate criteria for achieving or maintaining qualification status. Grandfathering, the acceptance of a Professional Engineer or Engineer-in-Training certificate, or lifetime qualification,” the Level IA-E status will need to be phased out over the next three years.

Note: All Level IA Exempt technicians were notified by email on which phase ‘year’ they will need to be recertified by.
